GENERAL TERMS AND CONDITIONS

Last updated: September 12, 2026

1. Who we are and what these terms cover

Producer Academy

Email: producer.academy@mailfence.com

These terms govern contracts for digital products offered through https://www.produceracademy.net when incorporated into the relevant contract. Our products include downloadable materials for music production. Product descriptions specify the contents of each purchase.

Individual agreements take priority over these terms. Nothing here removes rights that applicable law does not permit us to exclude. A consumer is an individual entering into a transaction predominantly for purposes outside their trade or profession.

2. Product information and technical requirements

Before ordering, please review the product description, file formats, required digital audio workstation, plug-ins and software versions. Third-party software is included only where expressly listed as part of the product.

You need suitable equipment and an internet connection to obtain and use the files. We remain responsible for providing accurate product information and products that meet the agreed and legally required standards. A demonstration may illustrate a production context; the product description must identify what is actually included.

3. Ordering and contract formation

Our product listings invite you to place an order. You can review the selected products and correct your details before submitting the order. Activating the final payment-obligation button submits a binding offer to purchase the items shown in the order summary.

We accept your order by expressly confirming acceptance electronically or by making the purchased download available, whichever happens first. A message merely acknowledging receipt of your order is not acceptance unless it also confirms acceptance or provides the product.

The contract language is English. We send the contract confirmation, the applicable terms and required consumer information by email or another durable medium. Please retain these documents; a website link alone does not replace the required durable confirmation. You can also save these terms before ordering.

4. Prices and payment

Prices are stated in euros. The total payable, including applicable taxes and any additional charges, is disclosed before you submit your order. You can use the payment methods offered at checkout. Payment is due when the contract is concluded, subject to any different payment schedule expressly offered for your chosen method.

Changes to advertised prices apply to future orders. They do not by themselves alter an existing contract. If a genuine listing or processing error affects your order, we will contact you; any correction or cancellation of an existing contract must have a valid legal basis or your agreement.

5. Digital delivery

Products are supplied electronically rather than shipped physically. Unless a different delivery time is stated before purchase, we provide download access without undue delay after acceptance and confirmation of payment, subject to the requirements for beginning supply during a consumer's withdrawal period.

If you do not receive access or a file cannot be downloaded, contact us with your order details. Please keep a backup of the files you receive. This request does not restrict our delivery obligations, any agreed access period or your statutory remedies.

6. Product licences

The permitted uses of purchased content are governed by the product description and the Licensing terms made available before purchase: https://www.produceracademy.net/licensing. The version agreed for your purchase applies; later website changes do not automatically change an existing licence.

Samples and presets have different permitted uses from educational project files. Royalty-free use does not mean that copyright ownership transfers to you. Purchasing content does not in itself authorise sharing the source files, reselling a pack or using an artist's identity as an endorsement.

This section does not expand or replace the specific product licence. Individually agreed rights and permissions arising from mandatory law remain unaffected.

7. Consumer withdrawal and refunds

Consumers have a statutory right to withdraw where the law provides one. For a contract supplying digital content without a physical medium, the usual withdrawal period is 14 days from contract conclusion, subject to the statutory rules on when the period begins. Please consult the separate withdrawal instructions supplied before purchase and with your contract confirmation.

For paid digital content, early expiry of that right requires supply to have begun, your prior express consent to supply during the withdrawal period, your acknowledgment that the right is lost when supply begins, and the legally required contract confirmation. Accepting these general terms alone does not constitute that separate consent and acknowledgment.

We do not offer an additional voluntary change-of-mind refund entitlement unless expressly advertised or individually agreed. This does not affect statutory withdrawal rights, remedies for defective or undelivered content, or other mandatory refund rights.

8. Faulty content and statutory remedies

Your statutory rights apply if the content is not supplied or is defective. For consumer contracts concerning digital products, this includes the applicable rights under sections 327 et seq. of the German Civil Code. Depending on the circumstances, these may include bringing the product into conformity, a price reduction, ending the contract and damages.

We provide updates and information about them where required by law, for the period the law requires. Product requirements do not operate as a blanket exclusion of compatibility or conformity obligations.

Contact us with your order reference and a description of the problem so that we can investigate. We do not make mandatory rights conditional on reporting a defect within an additional, shortened deadline.

9. Accounts and responsible use

If you create an account, provide accurate information, protect your login credentials and tell us about suspected unauthorised access. You are not automatically responsible for every act performed through your account regardless of fault.

Do not use the service for fraud, unlawful distribution of content, harassment, malware, unauthorised access or deliberate interference with its operation. Rights to use purchased music-production content are determined by the applicable licence.

If action is necessary to address misuse, we may restrict the affected functionality proportionately. Where appropriate, we will explain the reason and allow an opportunity to resolve the issue. Urgent security measures may be taken immediately. Account restrictions do not automatically cancel paid contractual entitlements or statutory remedies.

10. Website materials and communications

Rights in website materials remain with their respective holders. Permission to use purchased products is governed separately by their licences. Other copying or exploitation requires permission unless permitted by law.

Sending a support request or suggestion does not transfer ownership of your intellectual property to us. We may process the material as necessary to respond and provide the requested service. Any additional publication or promotional use requiring permission will be agreed separately.

Personal-data processing is explained in our separate Privacy Policy. These terms do not constitute blanket consent to marketing or data transfers. Third-party websites and independently purchased services have their own terms; our responsibility for our own contractual performance remains unaffected.

11. Liability and availability

Liability is governed by the applicable statutory provisions. These terms do not introduce a contractual cap or a general exclusion of liability.

Maintenance or technical faults may interrupt website access. Such interruptions do not remove our obligations under existing contracts. We may change the products available for future purchases, but changes to already purchased content or continuing services remain subject to the contract and applicable law.

12. Complaints and consumer dispute resolution

Please send complaints to producer.academy@mailfence.com. Contacting support is not a condition for exercising your legal rights.

13. Applicable law and future versions

German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. Where mandatory consumer-protection rules of your country of habitual residence apply despite this choice of law, you retain their protection. Court jurisdiction follows the applicable statutory rules.

The terms agreed when your contract is concluded apply to that contract. Publishing a new version does not automatically amend earlier purchases or licences. Any change to an existing contractual relationship requires a valid legal basis or agreement.

If a provision is ineffective, the consequences follow the applicable law; mandatory statutory rules remain in place. These terms do not replace any separate legal notice, privacy information or consumer withdrawal instructions.
